This chapter first considers the more formal basis for the relationship between international law and European Union (EU) law by looking at the international law framework of EU law. It then discusses the approach of the EU legal order to international law and the various ways in which the two legal orders interact within the EU legal order. The chapter also considers reasons for and implications of the CJEU's approach. The Court of Justice of the European Union (CJEU) has held (...) that customary international law (CIL), just like treaty law, is a standard of assessment in the review of the validity of EU secondary legislation, thus ranking CIL more highly within the EU legal order than secondary legislation. Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)

The technologies used to govern performance at universities consist of monitoring and comparative instruments. They are designed to affect and direct behaviour. In these academic environments of exposure, comparison and self-monitoring are deeply entangled with a vulnerable affective economy. This article explores how these data may affect our moods and how academic value could be curated by other means and with care. Drawing on feminist new materialist thinking and speculative feminist storytelling, the article takes this picture of the actual as (...) a point of departure for discussing ways of experimenting with affirmative critique of the current use of data. Through a smaller experiment with thirty PhD students, the article discusses how to speculatively curate academic value by other means that provide more liveable world(ing)s than data visuals measuring performance and that engage other sensorial and affective registers. Lonely students typically underperform academically. According to several studies, the COVID-19 pandemic is an important risk factor for increases in loneliness, as the contact restrictions and the switch to mainly online classes potentially burden the students. The previously familiar academic environment, as well as the exchange with peers and lecturers on site, were no longer made available. In our cross-sectional study, we examine factors that could potentially counteract the development of higher education student loneliness during the COVID-19 pandemic from a (...) social network perspective. During the semester, N = 283 students from across all institutional faculties of a German comprehensive university took part in an online survey. We surveyed their social and emotional experiences of loneliness, their self-reported digital information-sharing behavior, and their current egocentric networks. Here, we distinguished between close online contacts and close offline contacts. In addition, we derived the interconnectedness and heterogeneity of students’ contacts. To obtain the latter, we used a novel two-step method combining t-distributed stochastic neighbor embedding and cluster analysis. We explored the associations of the aforementioned predictors on social and emotional loneliness separately using two hierarchical multiple linear regression models. Our results suggest that social loneliness is strongly related to digital information-sharing behavior and the network structure of close contacts. In particular, high information-sharing behavior, high number of close contacts, a highly interconnected network, and a homogeneous structure of close contacts were associated with low social loneliness. Emotional loneliness, on the other hand, was mainly related to network homogeneity, in the sense that students with homogeneous close contacts networks experienced low emotional loneliness. Overall, our study highlights the central role of students’ close social network on feelings of loneliness in the context of COVID-19 restrictions. Limitations and implications are discussed. French philosopher Louis Pierre Althusser (1918 -1990) helped define the politico-theoretical conjuncture of pre- and post-1968. Today, there is a recrudescence of interest in his thought, especially in light of his later work, published in English as Philosophy of the Encounter (Verso, 2006). This has led to renewed debates on the reformulation of conflicting notions of materialism, on the event as both philosophical concept and political construction, and on the nature of politics and the political. These original essays by leading (...) scholars aim to provide a new assessment of Althusser's thought, especially in relation to contemporary debates. Organized in four sections that represent the main currents in Althusser's scholarship, the book discusses materialism and the different formulations of the relationship between politics and philosophy, Althusser's interpretations of political thinkers (including Machiavelli, Deleuze and Gramsci), the resources he provides to critique political economy and politics in post-Marxist thought, and the theorization of ideology and politics. Based on three empirical studies, this research sets out to conceptualise and subsequently operationalise the construct of consumer perceived ethicality (CPE) of a company or brand. Study 1 investigates consumer meanings of the term ethical and reveals that, contrary to philosophical scholars' exclusively consequentialist or nonconsequentialist positions, consumers' ethical judgments are a function of both these evaluation principles, illustrating that not any one scholarly definition of ethics alone is capable of capturing the content domain. The resulting conceptualisation identifies six key (...) themes explicating the construct. Building upon these findings, studies 2 and 3 were conducted to operationalise CPE. Such operationalisation is an essential prerequisite for future explorations and theory development given the absence of a suitable tool to capture and quantify the strength and direction of CPE. The key focus was on developing a valid and reliable multi-item measurement tool that is practical, parsimonious and easy to administer. The scale's general applicability allows deployment in academic and business contexts as well as different research areas and doing thus facilitates the much-needed theory building in this new research area. This article deploys Peircean approach to bodily skills, foregrounding motricity as a semiotically mediated and a “suprasubjective” process. By examining two contrasting skills – javelin and martial arts – I draw out the relevance of dynamic movement to the semiotics of sport and embodiment. These contrasting movements expose different epistemological assumptions since they emerge in distinct cultural traditions. To attend to the cultural dimension of movement practices – including the mediation of signs making certain movement forms seem reasonable or desirable (...) in the first place – I highlight ecological dimensions of each somatic tradition. This ecological focus aligns with Peirce’s project of tracking how semiotic signs are positioned and mediated. To make ecological factors of motricity more recognizable, I contrast somatic engagements that take place on synthetic, predictable substrates and somatic engagements that take place on variable, unpredictable ground. In a similar way to the classic gestalt figure-ground relations, where perception of a figure depends on the particulars of the ground, I suggest that the ground upon which somatic action occurs shapes the way we make sense of it epistemologically. These different grounds – both literally and figuratively – operate representationally via thirdness: they lead us to conceptualize movement in culturally and historically particular ways. (shrink)

Background Decisions on limiting life-sustaining treatment for patients in the vegetative state (VS) are emotionally and morally challenging. In Germany, doctors have to discuss, together with the legal surrogate (often a family member), whether the proposed treatment is in accordance with the patient's will. However, it is unknown whether family members of the patient in the VS actually base their decisions on the patient's wishes. Objective To examine the role of advance directives, orally expressed wishes, or the presumed will of (...) patients in a VS for family caregivers' decisions on life-sustaining treatment. Methods and sample A qualitative interview study with 14 next of kin of patients in a VS in a long-term care setting was conducted; 13 participants were the patient's legal surrogates. Interviews were analysed according to qualitative content analysis. Results The majority of family caregivers said that they were aware of aforementioned wishes of the patient that could be applied to the VS condition, but did not base their decisions primarily on these wishes. They gave three reasons for this: (a) the expectation of clinical improvement, (b) the caregivers' definition of life-sustaining treatments and (c) the moral obligation not to harm the patient. If the patient's wishes were not known or not revealed, the caregivers interpreted a will to live into the patient's survival and non-verbal behaviour. Conclusions Whether or not prior treatment wishes of patients in a VS are respected depends on their applicability, and also on the medical assumptions and moral attitudes of the surrogates. We recommend repeated communication, support for the caregivers and advance care planning. (shrink)

We present a new road map for research on “How the Brain Got Language” that adopts an EvoDevoSocio perspective and highlights comparative neuroprimatology – the comparative study of brain, behavior and communication in extant monkeys and great apes – as providing a key grounding for hypotheses on the last common ancestor of humans and monkeys and chimpanzees and the processes which guided the evolution LCA-m → LCA-c → protohumans → H. sapiens. Such research constrains and is constrained by analysis of (...) the subsequent, primarily cultural, evolution of H. sapiens which yielded cultures involving the rich use of language. (shrink)

Our recent publication in Neuroethics re-constructed the perspectives of family caregivers of patients with disorders of consciousness on functional neurodiagnostics. Two papers criticized some of our methodological decisions and commented on some conclusions. In this commentary, we would like to further explain our methodological decisions. Despite the limitations of our findings, which we readily acknowledged, we continue to think they entail valid hypotheses that need further investigation. We conclude that some caregivers with high hopes for the recovery of their loved (...) ones with DOC will most likely not consider results of functional neuroimaging as guiding information for treatment decisions, despite efforts taken to deliver information to them. Caregivers of that type might argue that such test-results are not a reliable source of information for the judgement of whether their loved one is likely going to recover or not. We introduce the concept of epistemic beliefs to formulate this hypothesis and suggest that future qualitative studies in this area should be aware of such beliefs when investigating the effects of functional neurodiagnostics on knowledge communication and shared decision making for patients with DOC. The present study was conducted with the aim of constructing and validating a short form of the Profile of Mood States. The POMS is a widely-applied measure for the assessment of an individual's mood. Thus, it is of great relevance for many research questions in clinical and social psychology. To develop the short scale, we first examined psychometric properties and found the optimal 16-item solution among all valid combinations of the full POMS in an exploratory subsample of our complete representative (...) sample of the German general population. We then validated this model in a confirmatory subsample. Additionally, we examined its invariance across age groups and sex, as well as its reliability. Our results indicate that the POMS-16 is a valid and reliable measure of mood states with minimal losses compared to the 35-item version. Particularly where brevity and an economical assessment is desired, the POMS-16 should be considered. (shrink)

The article explores the relation between personal identity and life-changing decisions such as the decision for a certain career or the decision to become a parent. According to L.A. Paul, decisions of this kind involve “transformative experiences”, to the effect that - at the time we make a choice - we simply don’t know what it is like for us to experience the future situation. Importantly, she claims that some new experiences may be “personally transformative” by which she means that (...) one may become a “new kind of person” having a different subjective perspective and “identity”. The article discusses this understanding of a transformed future self. It will be argued that different notions of identity can be distinguished with respect to Paul’s claim: the notion of identity in the sense of a personality as well as the notion of numerical identity in the sense of sameness. By distinguishing these two notions it will become more clear how a future experience may indeed qualify as “personally transformative”. Moreover, it will be shown that the notion of a self-understanding of persons helps to further clarify the kind of change at issue. (shrink)

This research investigates how consumers’ ethical brand perceptions are affected by differentially valenced information. Drawing on literature from person-perception formation and using a sequential, mixed method design comprising qualitative interviews and two experiments with a national representative population sample, our findings show that only when consumers perceive their judgment of a brand’s ethicality to be pertinent, do they process information holistically and in line with the configural model of impression formation. In this case, negative information functions as a diagnostic cue (...) to form an unethical brand perception, irrespective of other positive information at hand. However, in the case where processing relevance of the un/ethical information provided is low, brand perception formation is algebraic, in which case positive information can counterbalance and neutralize the detrimental impact of brand misbehavior. Our findings extend existing research on consumer perceived ethicality as well as consumer reactions to corporate social responsibility and sustainability initiatives, which has so far assumed the asymmetric impact of negative information on ethical perceptions and consumer attitudes to be prevalent. We derive a range of academic and managerial implications and present a number of important avenues for future research. (shrink)

Court interpreting in Croatia is a very unregulated field especially regarding the training and the skills that are to be acquired in order to pro- vide accurate translation at courts. One of the prerequisites according to the Regulations on Court Interpreters in Croatia is knowledge of the structure of judicial power, state government and legal terminology. Although the Regulations prescribe that the training should last no longer than two months, the organisations providing such training shorten this to three or four (...) days. Taking into account all that has been said one realizes that in such short time a per- son cannot be properly qualified to practice as a court interpreter. According to the EU Directive on the right to interpretation and translation in criminal proceedings member states should provide adequate training in order to ensure the quality of interpretation and to avoid that suspected or accused persons complain that the quality of interpretation was not good enough to secure the fairness of the proceeding, which according to Article 2 of the Directive they have the right to. Since Croatia joined the European Union on 1 July 2013, it will have to change its Regulations on Court Interpreters in order to com- ply with this Directive. This paper will try to analyze the problems within the scope of court interpreter’s profession in Croatia both in civil and in criminal proceedings. Several examples will be suggested as the possible model for modifying court interpreting in Croatia. Since this profession is often underrated by the national courts, the paper will suggest ways to prevent such views and point out the importance of good court interpretation. (shrink)

At its heart, design is a studio-based discipline, which makes it difficult for design educators to adopt technology-driven changes into an online teaching and learning environment. Globally, few universities offer online undergraduate degree design courses, despite an overall growth in online higher degree curricula. Anecdotal evidence and limited research studies exploring the design educators’ view lament the potential loss of direct interactions between educator and design students in an online learning environment making it impossible to offer design education online. However, (...) the attitude of design students towards online learning is largely underexplored. Given that today’s design students are considered tech-savvy, and there is a growing student demand for flexible study options, it would seem that design students would embrace online delivery options. The aim of this study is to explore the perception of undergraduate design students towards the idea of studying design online and whether or not blended learning could provide a transitional middle ground to a fully online design course. This study also touches on any student reservations about online delivery and identifies the barriers to study design online. (shrink)

The biologist and founder of Umwelt-Research Jakob von Uexküll used cinematographic techniques in many ways. This article explores three of these. First, Uexküll uses chronophotography to investigate the locomotion of marine organisms and insects, making multiple exposures on a single photographic surface to facilitate comparison between different phases of locomotion. Second, according to Uexküll, observing the motions of the living being in this way renders visible the ‘conformity with plan’ that is particular to each organism. The technique of cinematography is (...) therefore original to his investigation of the plan-like character of organisms. Third, in his later works Foray into the World of Humans and Animals ([1934] 2010) and Theoretical Biology ([1920] 1926), Uexküll uses cinematography to demonstrate his theory that the life of every living being unfolds in its own perceptual world possessing of its own subjective time and spatiality. It is in this context that one has to understand the centrality of his references to ‘pre-cinematographic’ experiments on and theories of perception. (shrink)

Vogt puts forward a novel version of the Guise of the Good: the desire to have one's life go well shapes and sustains mid- and small-scale motivations. Her book lays out a non-relativist version of Protagoras's Measure Doctrine and defends a new realism about good human lives.

Person‐specific evidence was developed as a grounded theory by analyzing 20 selected case descriptions from interventions using the guided self‐determination method with people with various long‐term health conditions. It explains the mechanisms of mobilizing relational capacity by including person‐specific evidence in shared decision‐making. Person‐specific self‐insight was the first step, achieved as individuals completed reflection sheets enabling them to clarify their personal values and identify actions or omissions related to self‐management challenges. This step paved the way for sharing these insights and (...) challenges in a relationship with a supportive health professional, who could then rely on person‐specific evidence instead of assumptions or a narrow disease perspective for shared decision‐making. Trust in the evidence encouraged the supportive health professional to transfer it to the interdisciplinary team. Person‐specific evidence then enhanced the ability of team members to apply general evidence in a meaningful way. The increased openness achieved by individuals through these steps enabled them to eventually share their new self‐insights in daily life with other people, decreasing loneliness they experienced in self‐management. Relational capacity, the core of the theory, is mobilized in both people with long‐term health conditions and healthcare professionals. Further research on person‐specific evidence and relational capacity in healthcare is recommended. (shrink)

In this paper, it is argued the Stoics develop an account of corporeals that allows their theory of bodies to be, at the same time, a theory of causation, agency, and reason. The paper aims to shed new light on the Stoics' engagement with Plato's Sophist . It is argued that the Stoics are Sons of the Earth insofar as, for them, the study of corporeals - rather than the study of being - is the most fundamental study of reality. (...) However, they are sophisticated Sons of the Earth by developing a complex notion of corporeals. A crucial component of this account is that ordinary bodies are individuated by the way in which the corporeal god pervades them. In this paper, I explore German playwright Bertolt Brecht’s conception of the art of acting, and his views on the new actor’s conduct towards their craft, as a pedagogical model for Brechts’ broader view on how we should live our lives. Drawing on his key writings – most importantly, his famous street scene essay – I will show that Brecht’s conception of the theory-practice connection in his approach to actor training/acting bears some deeper insight into Brecht’s conception of the art (...) of living a flourishing life. The new actor is called to develop a conduct of careful observation and imitation of human action, one that is marked by the pleasure and lightness of exploring the contradictory workings of the social world. By placing the actor’s craft at the heart of his educational philosophy, Brecht invites us (the audience) into the theatre as a pedagogical space. Here, not unlike Brecht’s actors, we are summoned to hone our ability to boldly engage with a complex world of human actions and ideas. Brecht maintains that there resides an intellectual as well as sensual delight in being challenged to not simply accept theatre’s presentations as ‘truth’; instead, we are to learn to ‘weigh up’, ‘test’, and ‘improvise’ joyfully with theatre’s proposed ideas and practices—so that we may find out if they serve, or hinder, the creation of a larger flourishing life (beyond the theatre): a life in which we can move together, pleasurably. In the essay ‘Sexual Differing’ from their book New Materialism: Interviews and Cartographies, Rick Dolphijn and Iris van der Tuin develop their new materialist take on sexual difference through their rereading of Simone de Beauvoir’s The Second Sex. I propose to read this essay as deploying the ‘analytical tool’ of ‘jumping generations’ articulated in the homonymous paper by van der Tuin as signature of the ‘new materialist’ ‘third wave’ of feminist theory. By pointing to the immediate textual context of the (...) passages from The Second Sex quoted in ‘Sexual Differing’, to the philosophical underpinning of Beauvoir's work, and to the historical context of its reception, I argue that while the tool of ‘jumping generations’, as put to use in ‘Sexual Differing’, might produce unexpected outcomes, it also risks confining to dusty feminist archives segments of feminist philosophy that might still be relevant for thinking gendered oppression and liberation today: Beauvoir's understanding of the social ontogenesis of freedom, the collective and egalitarian nature of political transformation and the genealogy of materialist feminist thought theoretically and historically linked to Beauvoir and The Second Sex. The issue is not merely one of historical and theoretical accuracy, but of enabling a capacious materialist analysis of gendered oppression and liberation. I conclude by pointing at how Dolphijn and van der Tuin's approach expressly discards understandings of history and scholarship that it nevertheless necessarily performs, and propose that this can be taken as a starting point to rethink sexual differing in terms of a political and ethical commitment beyond its originary metaphysical new materialist articulation. This is where, I propose, the above-mentioned conceptual resources linked to The Second Sex and muted by ‘Sexual Differing’ could prove fruitful, and timely. (shrink)

Deep brain stimulation — a novel surgical procedure — is emerging as a treatment of last resort for people diagnosed with neuropsychiatric disorders such as severe obsessive-compulsive disorder. The US Food and Drug Administration granted a so-called humanitarian device exemption to allow patients to access this intervention, thereby removing the requirement for a clinical trial of the appropriate size and statistical power. Bypassing the rigors of such trials puts patients at risk, limits opportunities for scientific discovery, and gives device manufacturers (...) unique marketing opportunities. We argue that Congress and federal regulators should revisit the humanitarian device exemption to ensure that it is not used to sidestep careful research that can offer valuable data with appropriate patient safeguards. Examining movement learning though Piercean semiotics, this article affirms the basic embodied notion that to utilize one’s body constitutes a form of thought. Through a case study that focuses on theorization of skilled movement in a Japanese martial art that has been transported into North America, I examine processes involved in somatic learning, including both ontological as well as epistemological aspects. I suggest that embodied skills are passed on through story telling, rather than through more conventional models of “passing down (...) information.” Learning somatic skills, or learning more generally, can thereby be conceptualized as a process of attuning judgment, in contrast to acquiring a set of internalized representations about the world. Despite widespread support for the idea of measuring EI as an ability based on Mayer and Salovey’s model, only a few performance-based EI tests have been developed. I argue that both the original and updated ability EI model provide little guidance for a theory-driven generation of items and their scoring, as the functions and processes associated with high and low EI are not specified in enough detail. One solution is to draw on theories from other fields when creating a measurement (...) rationale for a new EI test. I illustrate this approach by describing two new tests measuring emotional understanding and emotion management. (shrink)

The Stoics identify the law with the active principle, which is corporeal, pervades the universe, individuates each part of the world, and causes all its movements. At the same time, the law is normative for all reasoners. The very same law shapes the movements of the cosmos and governs our actions. With this reconstruction of Stoic law, I depart from existing scholarship on whether Stoic law is a set of rules. The question of whether ethics involves a set of rules (...) is rich and fascinating. In the 1970s and 80s, the observation that ancient ethics might do without rules was part of philosophy’s rediscovery of virtue ethics. This debate, however, neglects that Stoic law is a corporeal principle pervading the world. The key puzzle regarding Stoic law, I argue, is how it is possible that the very same law is a corporeal principle in the world and normative for us. (shrink)

For centuries, herbarium specimens were the focus of exchange in global botanical networks. The aim was the ‘complete’ registration of the flora, for which ‘complete’ collections in botanical institutions worldwide were considered to be a necessary basis, although this ardently sought-after ideal was never achieved. The study of colonial plants became a special priority of botanical research in the metropolises. With knowledge of the many treasures of the plant world considered the key to securing wealth and power, political and economic (...) interests influenced both the organization and the subject matter of scientific research. After the German Reich began annexing colonies in the 1880s, legal regulations established Berlin's botanical institutions as the research centre on colonial flora. They also became a clearing house for plant material from overseas. Berlin-based curators selected duplicates of herbarium specimens from the German colonies, distributing them to other botanical institutions throughout Germany. More importantly, duplicates became a form of currency in trans-imperial networks, which relied on reciprocity. In exchange for duplicate German colonial herbarium specimens, the Berlin institutions received vast quantities of botanical samples from their British, Dutch, French and American counterparts. The tendency towards an increasing integration of the informational web into our daily physical world (in particular in so-called Ambient Intelligent technologies which combine ideas derived from the field of Ubiquitous Computing, Intelligent User Interfaces and Ubiquitous Communication) is likely to make the development of successful profiling and personalization algorithms, like the ones currently used by internet companies such as Amazon, even more important than it is today. I argue that the way in which we experience ourselves necessarily goes through (...) a moment of technical mediation. Because of this algorithmic profiling that thrives on continuous reconfiguration of identification should not be understood as a supplementary process which maps a pre-established identity that exists independently from the profiling practice. In order to clarify how the experience of one’s identity can become affected by such machine-profiling a theoretical exploration of identity is made (including Agamben’s understanding of an apparatus, Ricoeur’s distinction between idem- and ipse-identity, and Stiegler’s notion of a conjunctive–disjunctive relationship towards retentional apparatuses). Although it is clear that no specific predictions about the impact of Ambient Intelligent technologies can be made without taking more particulars into account, the theoretical concepts are used to describe three general scenarios about the way wherein the experience of identity might become affected. To conclude, I argue that the experience of one’s identity may affect whether the cases of unwarranted discrimination resulting from ubiquitous differentiations and identifications within an Ambient Intelligent environment, will become a matter of societal concern. In contrast to Christopher Kelty’s case for the “careful cultural analysis of the domesticated forms that open source is taking” – which we agree to be a very useful endeavor – we would like to stick with the original call for papers for this special issue, that explicitly addresses the critical power of free software and a necessary shift to epistemologies. In our contribution we are responding to the aims of this special issue and to some of the contributions from (...) the perspective of feminist epistemology. There are several reasons for this decision. First of all, feminist scholars have been amongst the rst and most explicit to stress the linkages between knowledge and power. Apart from this generic focus, speci c feminist approaches, namely the approaches proposed by Helen Longino, Karen Barad and Lucy Suchman, o er invaluable insights for understanding the critical power of free software as a practice, which enables the materialization of principles into objects, as Kelty rightly emphasizes. Furthermore, feminist approaches suggest looking at epistemological politics and the situatedness of knowledge practices including e ects of perspectivism and marginalization. We adopt a performative understanding of epistemic practices, an understanding that take the interrelations between epistemology, ontology and ethics seriously. Thus, we start our inquiry from Kelty’s observation that free software “promises a sequence of [...] values: experimentalism and creativity, provisionality and modi ability, recti cation and refraction, dissent and critique, participation and obligation“ and that it „allows values and principles to be turned into material objects“. These and other values have already been inscribed in the launch of the GNU project in the beginning 1980s, the creation of the GPL, and they are continuously realized in the Free Software movement. Hence the interesting question is how they are realized and how are they shaped vice-versa by practices. (shrink)

Celano’s book focuses on Aristotle’s Nicomachean Ethics and thirteenth-century scholastic appropriations of it. Its objectives are to unravel the inconsistencies in Aristotle’s accounts of eudaimonia, to establish the prominence of phronesis, and to reveal alterations of Aristotle’s phronesis in medieval moral thought. Celano’s textual analyses are laborious, and some features of his story may be considered stimulating insights. His construal of phronesis as primary to Aristotle’s moral conception, his emphasis on Albert’s contribution to medieval moral thought, and his inclusion of (...) the largely uncharted anonymous Erfurt commentary... Malcolm-Smith, Solms, Turnbull and Tredoux [Malcolm-Smith, S., Solms, M.,Turnbull, O., & Tredoux, C. . Threat in dreams: An adaptation? Consciousness and Cognition, 17, 1281–1291.] have made an attempt to test the Threat-Simulation Theory , a theory offering an evolutionary psychological explanation for the function of dreaming [Revonsuo, A. . The reinterpretation of dreams: An evolutionary hypothesis of the function of dreaming. Behavioral and Brain Sciences, 23, 877–901]. Malcolm-Smith et al. argue that empirical evidence from their own study as well as (...) from some other studies in the literature does not support the main predictions of the TST: that threatening events are frequent and overrepresented in dreams, that exposure to real threats activates the threat-simulation system, and that dream threats contain realistic rehearsals of threat avoidance responses. Other studies, including our own, have come up with results and conclusions that are in conflict with those of Malcolm-Smith et al. In this commentary, we provide an analysis of the sources of these disagreements, and their implications to the TST. Much of the disagreement seems to stem from differing interpretations of the theory and, consequently, of differing methods to test it. (shrink)
